RELEASE AND HOLD HARMLESS AGREEMENT 

DEFEND THE FLOCK LLC

I, _______________________________________ (PRINT NAME), acknowledge and fully understand that my participation in any training, course, or event conducted or sponsored by DEFEND THE FLOCK LLC (DEFEND THE FLOCK MINISTRIES) involves inherent risks. These risks may include, but are not limited to, physical injury, illness, emotional distress, property damage, or even death. I understand that these risks may arise from my own actions, the actions of others, the environment, equipment use, or conditions beyond the control of DEFEND THE FLOCK LLC (DEFEND THE FLOCK MINISTRIES). I freely and voluntarily choose to participate in this training/event with the knowledge of these potential dangers. I confirm that I am physically able, emotionally stable, and fully competent to participate in training and shooting activities and that I freely, knowingly, and voluntarily assume the risks of participating in such activities, including the risks of property damage, bodily harm, and death. I further confirm that I am both capable and willing to follow all safety instructions and directions provided by instructors, staff, or representatives. 

I affirm that I will refrain from being under the influence of alcoholic beverages or medications that might impair judgment prior to, and during, shooting or training activities. Further, I affirm that the possession and influence of unlawful drugs is expressly prohibited during all DEFEND THE FLOCK MINISTRIES training activities. I understand that any person(s), including myself, who by observation appears to be under the influence of alcohol or unlawful drugs or emotionally unstable, shall be denied access to any part of any DEFEND THE FLOCK MINISTRIES training activities. 

In addition, I do for myself, and on behalf of my heirs, executors, administrators, officers directors, owners, partners, agents, brokers, employees insures, and assigns, hereby releases, acquits, indemnifies, and hold harmless DEFEND THE FLOCK MINISTRIES and its heirs, executors, administrators, trustees, officers, directors, owners, partners, agents, brokers, employees, insurers, assigns, and all other related persons, entities, affiliates, predecessors, and successors, from any and all claims, actions in law or equity (including attorney’s fees and costs), causes of actions, demands, rights, damages, costs, loss of services, expenses, and compensation whatsoever arising from any damage to property, injury to person, or death, (whether predicated upon negligence or otherwise) in connection with any DEFEND THE FLOCK MINISTRIES training activity, training facilities or locations, or participation in any activities therein. I also assume full legal and financial responsibility (including attorney’s fees and costs) for any damage or harm to myself and to any of my minor guests, minor spectators, minor bystanders, or minor training participants, if any, and for damages or harm to other individuals on the training premises, rental equipment, or other equipment that is a result my own actions or any of my minor guests, minor spectators, minor bystanders, or minor training participants 

I assume all risks, known and unknown, associated with participation in any training or activity conducted by or in connection with DEFEND THE FLOCK LLC (DEFEND THE FLOCK MINISTRIES).

In the event of injury or medical emergency, I authorize DEFEND THE FLOCK LLC (DEFEND THE FLOCK MINISTRIES) and its representatives to secure emergency medical treatment for me and for any of my minor guests during or after the commencement of any training activities. I understand that I am solely responsible for all costs related to such medical care. 

I grant DEFEND THE FLOCK LLC (DEFEND THE FLOCK MINISTRIES) permission to use any photographs, video, or audio recordings of me for training, marketing, or promotional purposes without compensation. 

I agree that all issues and questions concerning the construction, validity, enforcement, and interpretation of this waiver agreement shall be governed by, and construed in accordance with, the laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that could cause the applications of the laws of any jurisdiction other than the State of Florida. 

I agree that any dispute, injury to myself or any of my minor guests, including death, arising from any DEFEND THE FLOCK MINISTRIES training activity in which I or any of my minor guests is or was a participant, guest, or bystander shall be governed by the laws of the State of Florida, and if applicable, I agree that proper venue giving effect to any choice of law or conflict of law rules or provisions that could cause the applications of the laws of any jurisdiction other than the State of Florida. 

I also agree that the venue of any action related to the waiver agreement or to enforce the provisions of this waiver agreement, or any document executed in connection with this waiver agreement, shall be in Miami, Florida.

I agree that if any provision of this agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. 

By signing below, I acknowledge that I have carefully read this entire agreement, fully understand its terms, and voluntarily agree to be bound by them. I am signing this document freely and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
